In the past day the Parliamentarian has ruled that the following require 60 votes: - Defunding the Consumer Financial Protection Bureau - Selling western federal lands - Limits on states’ use of provider taxes, which if implemented would've cut Medicaid by 100s of billions
No way around it. Biden simply could not do it. 1) It needed to be an act of Congress, executive does not have power alone. 2) It needs either 60 votes or a majority willing to kill the filibuster, de-jure or de-facto by overriding the parliamentarian. 3) Neither existed.
